FilmDeck Privacy Policy

This Privacy Policy ("Policy") explains how FilmDeck™ (operated by FilmDeck Enterprises PTY LTD trading as FilmDeck, "FilmDeck", "we", "us", or "our") collects, uses, stores, shares, and protects personal data in connection with the FilmDeck streaming platform, submission portal, website, and associated services (collectively, the "Platform").
This Policy applies to all individuals who interact with the Platform, including Creators who submit Content for consideration and viewers and visitors who access the Platform (collectively, "you" or "your").
This Policy should be read alongside FilmDeck's Submission Terms and Conditions, which govern the submission of Content to the Platform. Capitalised terms used but not defined in this Policy have the meanings given to them in the Submission Terms and Conditions.
FilmDeck is committed to protecting your personal data and handling it responsibly, transparently, and in accordance with applicable data protection laws. As at the date of this Policy, the Platform is provided free of charge. FilmDeck does not currently generate revenue through subscription fees, advertising, or any other means.
By using the Platform or submitting Content, you acknowledge that you have read and understood this Policy. If you do not agree with this Policy, please do not use the Platform or submit Content.
1. Who We Are
1.1 Data Controller
FilmDeck Enterprises PTY LTD (trading as FilmDeck) (ABN 56 697 589 594) is the data controller responsible for the personal data collected through the Platform. This means FilmDeck determines the purposes and means of processing your personal data.

1.3 Governing Law
This Policy is governed by the laws of New South Wales, Australia, and FilmDeck operates in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs) contained therein. Where you are located outside Australia, additional local data protection rights may apply (for example, the GDPR if you are in the UK or EU), and FilmDeck will endeavour to comply with those rights to the extent required by applicable law.
2. Personal Data We Collect
2.1 Data You Provide Directly
FilmDeck collects personal data that you provide when you interact with the Platform, including:
- Identity data: your full name, username, or screen name;
- Contact data: your email address, telephone number, and any other contact details you provide;
- Submission data: information provided as part of a Content submission, including your role (director, producer, etc.), production company name, project title, synopsis, credits, and any other information included in your submission form;
- Account data: login credentials and account preferences, where you create an account on the Platform;
- Communications data: the content of any messages, emails, or correspondence you send to FilmDeck.
2.2 Data Collected Automatically
When you visit the Platform or use its features, FilmDeck and its third-party service providers may automatically collect the following data:
- Usage data: pages visited, Content viewed, search queries, time spent on the Platform, and interaction data;
- Device data: device type, operating system, browser type and version, screen resolution, and unique device identifiers;
- Network data: IP address, approximate geographic location (derived from IP address), and internet service provider;
- Referral data: the URL or source from which you arrived at the Platform.
2.3 Cookies and Tracking Technologies
FilmDeck uses cookies and similar tracking technologies to collect certain data automatically. Please see Section 9 of this Policy for full details of how FilmDeck uses cookies and how you can manage your preferences.
2.4 Data from Third Parties
FilmDeck may receive limited personal data about you from third-party sources, including:
- social media platforms, where you interact with FilmDeck's Social Media Channels;
- analytics providers, who provide aggregated or anonymised data about Platform usage;
- payment processors, if and when FilmDeck introduces paid features in the future.
2.5 Data We Do Not Collect
FilmDeck does not intentionally collect sensitive personal data (such as data relating to health, religion, political opinions, or biometric data) through the Platform. Please do not submit sensitive personal data unless specifically requested by FilmDeck for a stated purpose.
3. How We Use Your Personal Data
3.1 Purposes of Processing
FilmDeck uses your personal data for the following purposes:
- Managing submissions: to receive, review, process, and respond to Content submissions, and to communicate with you about the status of your submission;
- Operating the Platform: to provide, maintain, and improve the Platform and its features, including creator accounts and analytics dashboards;
- Communication: to send you updates about your submission, notify you of changes to the Platform or these policies, and respond to your enquiries;
- Platform analytics: to understand how the Platform is used, measure audience engagement, and improve the user experience;
- Promotional activity: to promote the Platform and featured Content through FilmDeck's website, Social Media Channels, and other marketing channels, using Content metadata and Promotional Materials in accordance with the Submission Terms and Conditions;
- Legal compliance: to comply with applicable laws, respond to legal requests, and enforce FilmDeck's rights under the Submission Terms and Conditions;
- Security: to detect, prevent, and respond to fraud, abuse, security incidents, and technical issues;
- Business operations: for internal record-keeping, financial administration, and operational planning.
3.2 Legal Basis for Processing
Where applicable data protection law requires FilmDeck to identify a legal basis for processing your personal data, FilmDeck relies on the following:
- Contract performance: processing necessary to manage your submission and fulfil FilmDeck's obligations under the Submission Terms and Conditions;
- Legitimate interests: processing necessary for FilmDeck's legitimate interests in operating and improving the Platform, promoting Content, and ensuring platform security, where those interests are not overridden by your rights;
- Legal obligation: processing necessary to comply with applicable laws and regulatory requirements;
- Consent: where you have given your consent to specific processing activities, such as receiving marketing communications or the use of non-essential cookies. You may withdraw consent at any time without affecting the lawfulness of processing carried out before withdrawal.
3.3 No Automated Decision-Making
FilmDeck does not make decisions about you that produce legal or similarly significant effects based solely on automated processing of your personal data.
4. How We Share Your Personal Data
4.1 General Principle
FilmDeck does not sell your personal data to third parties. FilmDeck shares personal data only in the circumstances described in this Section 4.
4.2 Service Providers
FilmDeck works with trusted third-party service providers who process personal data on FilmDeck's behalf in order to operate the Platform. These include:
- cloud hosting and storage providers;
- email and communications platforms;
- website analytics providers (such as Google Analytics or equivalent);
- video hosting and streaming infrastructure providers;
- customer support tools.
All service providers are required to process personal data only on FilmDeck's instructions and in accordance with applicable data protection law. FilmDeck takes reasonable steps to ensure that service providers maintain appropriate security standards.
4.3 Social Media Platforms
Where FilmDeck shares Promotional Materials on its Social Media Channels, limited data (such as your name as a credited creator) may be visible to users of those platforms. FilmDeck does not share your contact details or submission data with social media platforms except as required by the operation of those platforms' standard features.
4.4 Legal Authorities
FilmDeck may disclose your personal data to law enforcement agencies, courts, regulators, or other public authorities where required or permitted by applicable law, including in response to a valid legal request, court order, or to protect the rights, property, or safety of FilmDeck, its users, or the public.
4.5 Business Transfer
If FilmDeck undergoes a merger, acquisition, restructuring, or sale of all or substantially all of its assets, your personal data may be transferred to the acquiring entity as part of that transaction. FilmDeck will use reasonable efforts to notify you of any such transfer and to ensure that your personal data continues to be protected in accordance with this Policy.
4.6 With Your Consent
FilmDeck may share your personal data with third parties in other circumstances where you have given your explicit prior consent to such sharing.
5. Data Retention
5.1 Retention Periods
FilmDeck retains personal data only for as long as necessary to fulfil the purposes for which it was collected, or as required by applicable law. The following general retention periods apply:
- Submission data: retained for the duration of your Content's presence on the Platform and for a period of up to three (3) years following removal or rejection of your submission, for record-keeping and legal compliance purposes;
- Account data: retained for the duration of your account and for up to two (2) years following account closure or inactivity;
- Communications data: retained for up to two (2) years from the date of the last communication, unless a longer period is required for legal or dispute resolution purposes;
- Usage and analytics data: retained in anonymised or aggregated form for up to three (3) years for platform improvement purposes;
- Legal and compliance records: retained for the period required by applicable law, which may be up to seven (7) years in certain jurisdictions.
5.2 Deletion
When personal data is no longer required, FilmDeck will securely delete or anonymise it. Where deletion is not immediately possible (for example, because data is stored in backup systems), FilmDeck will isolate the data from further processing until deletion is possible.
6. Data Security
6.1 Security Measures
FilmDeck takes the security of your personal data seriously and implements appropriate technical and organisational measures to protect it against unauthorised access, loss, destruction, alteration, or disclosure. These measures include:
- encryption of data in transit using industry-standard protocols (such as TLS/SSL);
- access controls limiting personal data access to authorised personnel only;
- regular review of security practices and third-party service provider security standards;
- secure storage of personal data on reputable cloud infrastructure providers.
6.2 No Absolute Guarantee
While FilmDeck takes reasonable steps to protect your personal data, no method of transmission over the internet or electronic storage is completely secure. FilmDeck cannot guarantee the absolute security of your personal data and accepts no liability for unauthorised access or loss of data that is beyond FilmDeck's reasonable control.
6.3 Data Breach Notification
In the event of a personal data breach that is likely to result in a risk to your rights and freedoms, FilmDeck will notify the relevant supervisory authority and, where required, affected individuals, in accordance with applicable data protection law and within the timeframes required by that law.
7. Your Data Protection Rights
7.1 Rights Available to You
Depending on your location and applicable data protection law, you may have the following rights in relation to your personal data:
- Right of access: the right to request a copy of the personal data FilmDeck holds about you;
- Right to rectification: the right to request correction of inaccurate or incomplete personal data;
- Right to erasure: the right to request deletion of your personal data in certain circumstances (also known as the "right to be forgotten");
- Right to restriction: the right to request that FilmDeck restricts the processing of your personal data in certain circumstances;
- Right to data portability: the right to receive your personal data in a structured, commonly used, and machine-readable format, and to transmit it to another controller, where technically feasible;
- Right to object: the right to object to processing of your personal data based on legitimate interests, including for direct marketing purposes;
- Right to withdraw consent: where processing is based on your consent, the right to withdraw that consent at any time without affecting the lawfulness of prior processing.
7.2 How to Exercise Your Rights
To exercise any of the rights listed above, please contact FilmDeck at rights@filmdeck.com.au. FilmDeck will respond to your request within thirty (30) days of receipt. FilmDeck may request verification of your identity before processing your request.
7.3 Complaints
If you are not satisfied with how FilmDeck handles your personal data or responds to your request, you have the right to lodge a complaint with the relevant data protection supervisory authority in your jurisdiction. FilmDeck encourages you to contact us first so that we can attempt to resolve your concern directly. If you are an Australian user and remain dissatisfied with FilmDeck's response, you may lodge a complaint with the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au.
8. International Data Transfers
8.1 Cross-Border Transfers
FilmDeck operates as a global platform and may transfer your personal data to countries outside your country of residence, including countries that may not provide the same level of data protection as your home jurisdiction.

Where FilmDeck transfers personal data internationally, it will ensure that appropriate safeguards are in place to protect your data, which may include:
- transferring data to countries that have been recognised as providing an adequate level of data protection by the relevant authority;

Some of FilmDeck's third-party service providers (such as cloud hosting and analytics providers) may process personal data in jurisdictions outside your country of residence. FilmDeck takes reasonable steps to ensure that such providers maintain appropriate data protection standards.
9. Cookies & Tracking Technologies
9.1 What Are Cookies
Cookies are small text files placed on your device when you visit a website. FilmDeck uses cookies and similar tracking technologies (such as pixels and local storage) to operate the Platform, understand how it is used, and improve the experience for all users.
9.2 Types of Cookies FilmDeck Uses
FilmDeck uses the following categories of cookies:
- Strictly necessary cookies: essential for the Platform to function. These cannot be disabled as they are required for core features such as login sessions and security. No consent is required for these cookies;
- Analytics cookies: used to collect information about how visitors use the Platform (such as pages visited and time spent), to help FilmDeck improve its services. These cookies collect anonymised or aggregated data;
- Functional cookies: used to remember your preferences and settings (such as language preferences) to improve your experience;
- Marketing and social media cookies: used by FilmDeck's Social Media Channel integrations (such as embedded video players or share buttons) to track interactions. These are set by third-party platforms and are subject to those platforms' own privacy policies.

You can manage your cookie preferences in the following ways:
- Cookie consent tool: when you first visit the Platform, you will be presented with a cookie consent banner allowing you to accept or decline non-essential cookies;

9.4 Do Not Track
Some browsers transmit "Do Not Track" signals. FilmDeck does not currently respond to Do Not Track signals, but you may use the cookie management options described above to limit tracking.
10. Children's Privacy
10.1 Age Restriction
The Platform is intended for use by individuals who are at least 18 years of age (or the age of majority in their jurisdiction). FilmDeck does not knowingly collect personal data from children under the age of 13 (or the applicable minimum age in your jurisdiction, which may be higher in some countries, for example, 16 in certain EU member states).
10.2 Parental Action
If FilmDeck becomes aware that it has inadvertently collected personal data from a child below the applicable minimum age without verifiable parental consent, FilmDeck will take prompt steps to delete that data. 11. Third-Party Links & Platforms
11.1 External Links
The Platform may contain links to third-party websites, social media platforms, or services that are not operated by FilmDeck. This Policy does not apply to those third-party services. FilmDeck is not responsible for the privacy practices of third-party platforms and encourages you to review their privacy policies before providing any personal data.
11.2 Social Media Embeds
Where the Platform embeds content from third-party social media platforms (such as YouTube or Instagram), those platforms may collect data about your interaction with the embedded content in accordance with their own privacy policies. FilmDeck has no control over such data collection.
12. Changes to This Privacy Policy
12.1 Updates
FilmDeck reserves the right to update or amend this Policy at any time to reflect changes in applicable law, FilmDeck's data practices, or the development of the Platform. The updated Policy will be posted on the FilmDeck website with a revised effective date.
12.2 Notification of Material Changes
Where FilmDeck makes a material change to this Policy, for example, a change to the types of data collected, the purposes for which it is used, or the parties with whom it is shared, FilmDeck will use reasonable efforts to notify affected individuals by email or by a prominent notice on the Platform prior to the change taking effect.
12.3 Continued Use
Your continued use of the Platform following the posting of an updated Policy constitutes your acceptance of the revised terms. If you do not agree with the updated Policy, you should discontinue use of the Platform and may request deletion of your personal data in accordance with Section 7.

13.2 Response Times
FilmDeck will acknowledge your enquiry within five (5) business days and will endeavour to provide a full response within thirty (30) days of receipt. Where a request is complex or involves a large volume of data, FilmDeck may extend this period by a further thirty (30) days and will notify you accordingly.
13.3 Related Policies
This Privacy Policy should be read alongside FilmDeck's Submission Terms and Conditions, which are available at www.filmdeck.com.au/terms. In the event of any conflict between this Policy and the Submission Terms and Conditions on a data protection matter, this Policy shall prevail.
